商标注册的流程

Process of trademark registration

商标（trade mark）是一个专门的法律术语。品牌或品牌的一部分在政府有关部门依法注册后，称为“商标”。商标受法律的保护，注册者有专用权。国际市场上著名的商标，往往在许多国家注册。中国有“注册商标”与“未注册商标”之区别。注册商标是在政府有关部门注册后受法律保护的商标，未注册商标则不受商标法律的保护。

Trade mark is a special legal term. A brand or part of a brand is called a "trademark" after it is registered by the relevant government departments according to law. The trademark is protected by law, and the registrant has the exclusive right. Famous trademarks in the international market are often registered in many countries. There is a difference between "registered trademark" and "unregistered trademark" in China. A registered trademark is a trademark that is protected by law after it is registered by the relevant government departments. A trademark that is not registered is not protected by trademark law.

第一步：查询商标能否注册

Step 1: check whether the trademark can be registered

注册商标时首先要提供要注册的名称、图形和类别，然后去检索查询有没有近似商标，判断一下该商标能否注册，以及注册的成功率。可以的话就进行下一步的注册流程，不可以的话就需要对注册的文本和图案进行修改，生成一个可以注册的商标。

When registering a trademark, you should first provide the name, figure and category to be registered, and then search whether there is a similar trademark, judge whether the trademark can be registered and the success rate of registration. If possible, the next registration process will be carried out. If not, the registered text and pattern need to be modified to generate a trademark that can be registered.

第二步：签订代理合同及支付款项

Step 2: signing agency contract and payment

注册的商标给出建议并可以达到注册要求后，就可以签订商标注册代理合同了

After the registered trademark gives suggestions and meets the registration requirements, a trademark registration agency contract can be signed

个人申请的话需要提供：身份证正反面（需签名）、彩色个体户执照（复印件签名）

Personal application needs to provide: front and back of ID card (signature required), color self-employed business license (copy signature)

公司申请的话需要提供：彩色营业执照（复印件需盖公章）

If the company applies, it needs to provide: color business license (the copy needs to be sealed with official seal)

合同签订后支付相应的注册费用就可以进行下一步注册了。

After the contract is signed, you can pay the corresponding registration fee for the next step of registration.

第三步：下发商标注册受理通知书

Step 3: issue trademark registration acceptance notice

准备好所需要的资料后，就可以提交给商标局申请注册了。提报后隔天就可以出注册号和电子回执单，这个时候就可以打TM使用了。文件上报15-30天商标局就会下发电子商标注册受理通知书。

After the necessary information is prepared, it can be submitted to the Trademark Office for registration. The registration number and electronic receipt can be issued the next day after submitting the report. At this time, TM can be used. Within 15-30 days after the documents are submitted, the Trademark Office will issue a notice of acceptance of electronic trademark registration.

第四步：商标实质审查阶段

Step 4: the stage of trademark substantive examination

商标提报后，在6个月左右会进入实质审查阶段，整体打R标的时间为9-12个月。若初审通过，则进入公告期，公告期为期3个月左右，若没有人提出异议就说明注册成功。如果实质审查没有通过，就会下发驳回通知书。

After the trademark is submitted, it will enter the stage of substantive examination about 6 months, and the overall time of r-marking is 9-12 months. If the preliminary examination is passed, the announcement period will be about 3 months. If no one raises an objection, it means the registration is successful. If the substantive examination fails, a notice of rejection will be issued.

第五步：下发商标注册证书

Step 5: issue trademark registration certificate

当上述所有的注册步骤都完成并且通过后，商标局就会下发官方正式的《商标注册证书》，整个商标注册流程就结束了，您的商标也就被合法保护了。

When all the above registration steps are completed and passed, the Trademark Office will issue the official trademark registration certificate, the whole trademark registration process will be finished, and your trademark will be legally protected.
