1、如何办理专利申请

办理专利申请应当提交必要的申请文件，并按规定缴纳费用。专利申请必须采用书面形式或者电子申请的形式办理。不能用口头说明或者提供样品或模型的方法，来代替书面申请文件。在专利审批程序中只有书面文件才具有法律效力。

各种手续文件都应当按规定签章，签章应当与请求书中填写的姓名或者名称完全一致。签章不得复印。涉及权利转移的手续，应当有全体申请人签章，其他手续可以由申请人的代表人签章办理，委托专利代理机构的，应当由专利代理机构签章办理。
